Guys, My Advanced Parole has just been approved, but I-94 expired two years ago. Can I travel out and come back without any problem? I filed my I-485 using the (245i) in March of 2002. Please anyone with experience to share?
When your I-94 was expired 2 years back it means you were out of status or stayed or worked illegally in USA and you may be subject to 3 year or 10 year bar and if you go out of US and try to enter using AP the 3/10 year bar still applies. Better talk to your lawyer you have filed under 245(i) it means you stayed illegal or worked illegally. you may not be allowed back to US.
