Advanced Parole and 245(i)

If you filed I-485 with the supplement form under 245(i), are you eligible for Advanced Parole?

you can apply...

And you will most probably get it. But until your condition for 245(i) is eliminated I wouldn\'t advise traveling out of US. This is my personal conservative opinion. Having an AP is not that advantageous for a 245(i) applicant.

Jaxen, Please what do you mean by until the condition for 245(i) is eliminated. Please explain to me so that I can understand.

Mere 1000 dollars payment

does not mean your condition (out of status or whatever) is ignored. Until a IIO sees your case and says OK this guy\'s 245(i) classification is legal, your past indiscretion is not ignored by INS.
The POE officers have known to act cruelly in a previous case (see murthy chats archive) and deport the person.
Consult a lawyer...

ADIS-you can do it

Hi

Applied for my wife under 245(i),since she was derivative applicant and after getting EAD ,we went to local INS office(Newark) in march 2 week and got AP(for her only) on same day,we were asked for 485 receipt notice and pp.

BTW our RD 01/XX/2002 AND VSC,then she travelled to UK(frist week of april) on H-4 and while returing back to US never used AP at POE

Hope this helps

Note that Nov140sagc did not use AP to enter. Using AP will trigger an intense scrutiny process and I have seen many users of this forum deported because they thought AP absolved their past indiscretions.
I would not advise the travel...An dI should withdraw my earlier immature comments. How do I do it??

It seems strange to advise you but you could click on the edit button on your post and either edit the message or use the button on the top left to delete it.

IF you read the AP document it clearely says they still have the right to deport you if you hv commited immigrations violations before. So take the jaxen's advice and wait for ur 485 approval or if u wanna go ahead and take the risk no one is stopping you.
