Advance Parole RFE questions- Pl. HELP

Hello Everyone,

I have applied Advance Parole for my wife & son. The AP got approved for my wife and I got RFE for my son saying that I have not signed in the signature column. I have signed in the signature of preparing person and mentioned as a parent. Last Thursday I sent the completed RFE through FedEx and attached covering letter with copy of the air ticket.


My question is :

1. Can I send Advance Parole after my son reaching to India by Fedex.?
2. Will they ask any AP documents when you leave from US?.
3. He is having valid H4 and I am having Valid H1 and I have not stamped in the passport. So in worst case, can he go for H4 stamping and is there any problem?.
4. Is there any new regulation for H4 stamping?
5. If GC is approved and will they send the Advance Parole after that?.

No, as per BCIS u need to carry ur AP before leaving the country

No, but generally BCIS advise to give a copy of AP to airlines before leaving the country..

It depends how your working, if ur using EAD to work then ur son must use AP or he can very well stamp at US consulate abroad

Not aware of any new rules..

Yes possible, as BCIS is supposed to take action on each and every case filed by applicants.

I think you need to be in US for applying AP. If you have already applied for, then you can send it to India before they come back. However, if AP is rejected, then you have a problem. In this case, you can send your H1 to India, so that your son gets a H4 stamp.

No, but generally BCIS advise to give a copy of AP to airlines before leaving the country..

You need to handover the I-94 to the airlines, before leaving US. Not the copy of your AP. You only need to show it to BCIS personal while re-entering US.
