Guys,
My I-485 has been applied around a year back. I am now planning a trip to India on Oct 18th. Just received Advance Parole for myself, my wife and kids, which was applied in April this year. Problem is that my wife and kids left for India around 4 months back. We are planning to return on Nov 9th using AP. Could there be any questioning at POE as to how come my wife left the US when her AP was'nt issued at that time? Do they check the dates on the passport? Can she be denied entry based on that?
I do have an H-1 approval valid until Dec 2004, but would need to get that stamped on my passport since my visa has expired for more than a year back. Would I need to get my stamping done? What would be safer? AP or H-1?
Any suggestions here would be appreciated.
