Advance Parole question

Hi,

My labor cerificate was approved few days back. I have H1 visa valid upto 2005 Sep.

If I apply for I-140 and I-485 concurrently and travel outside US can I use existing H1 visa to re-enter US? or do I need to get advance parole?

Any reply is appreciated.

You can continue to use your H1 as long as it is valid. If in future you decide to use EAD to seek a new job, you will need AP to travel.

You can use H1. Even if you use AP you can still be on H1.

My lawyer says I also need original I-485 receipt despite having a valid H1B in order to re-enter. So, essentially, after filing I485, there is a 4-5 week window when you cannot travel abroad. This is the time taken to receive the I485 receipt, or the parole whichever happens first.
