Advance Parole Question ######

Hi Folks:

My wife is on a 485 pending status (filed on base of my green card) and will be entering US in May end on an Advance Parole valid till 11/19/2004. I know entering will not be an issue but I have a concern regarding the I 94.

When she enters her I 94 will be stamped as "Parolled till 11/19/2004" Now what happens to her legality of stay in US. Is she Okay after 11/19 to stay in US based on her I 485 staus or she needs a valid I -94.

Based on my own experience I think she will be Ok but any comments or personal experiences will be helpful???

No she should be fine and have no problems to stay after that date.

The date on the I-94 will actually be one year from the date of entry, not the AP expiry date. But, alligator2 is right - while AOS is pending you remain in status even if the date of the I-94 passes.
