Advance Parole Question.

Hi Guys
can you please give me some tinsights on this issue.

on 2nd feb, my wife went to india on Emerganey AP which is valid till april 2nd 2004.
her Normal AP was approved on 19th Feb 2004, and is valid till 19th Feb 2005.
so the question is
if i mail her, new AP in india can she come after 2nd april using her Normal AP, so she has to come before 2nd april because she lft this country on EAP.

one more thing we did't sumitted the copy of EAP while leaving the country. and i came back without any questions asked.

Since her normal AP is approved she can use her AP valid till 2005.
the purpose of emergency AP is impending need to go out the country there no restricions for u to come back. However check with the lawyer to be safe.

Today, the USCIS issued a reminder that the people who are eligible to return to the U.S. with the Advance Parole should depart from the U.S. after the Advance Parole is approved. Otherwise they may not be able to reenter the U.S. It also warns those who are subject to the 3-year or 10-year bar should not depart from the U.S. with or without the Advance Parole as they will be barred from reentering the U.S. even if they carry an Advance Parole. I would say she needs to come back to the US BEFORE her eAP expires and if required leave again on her current AP.

You CANNOT travel on an AP that has been issued AFTER you leave the country.

But offcourse check with your lawyer, this is a complex issue and you dont' want to be caught on the wrong foot!

I know I'm hijacking this thread, btu how did you get approval for Emergency AP - just send in the I-131 requesting Emergency approval ASAP? My wife's grandfather is in serious condition and waiting even a week may be too long...
