Hi all, I got my GC through employment category recently but my wife is still awaiting
her I-485 approval. She has her EAD and advance parole documents. Last week she
came back from India and the immigration officer at the airport gave her an I-94 instead
of stamping the advance parole paper. The I-94 says that she is on H4. So basically
she forgot to tell the immigration office that she is carrying the advance parole papers.

What would be the consequence and will it me a major problem in her 485 approval ?.

Please advise as to what all can be done.

     Thanks

Per www.immihelp.com :

\'As long as the person maintains the H/L status(H/L status not expired and H1/L1 holders not working for any other employer other than sponsoring employer and H4/L2 holders not working at all), he/she can travel outside US and come back with out the need for advanced parole even after applying for adjustment of status. The person can enter using his/her non-expired H/L visa. For valid H/L visa holders, there is no need to apply for EAD to continue working after coming back to US. This rule is effective July 1, 1999.\'

Hi, Thanks for the response. But my wife worked on EAD for couple
months in 2000yr. So I am guessing that she lost her H4 status when she started
working on EAD. So in 2001 when she came back to USA from India she should
have used advance parole since she is no longer maintaining H4 status ?.

So is she on invalid status now ?. Please advise
