Hi Friends

I got my EAD back in Feb'02. I am planning to apply for AP for my wife. Attorney is saying, it takes 30-45 days (Virginia). She might need to go earlier than that (though the reason is not an emergency, planning to leave in First week of Aug'02). Here are my issues

1. Attorney is charging another $300 (plus regular $110 INS fee) for doing this, Can I apply on my
own, if Yes, then what are the documents necessary to send and where I am supposed to send.

2. Is it better attorney handle this

3. Can I go to local INS office and request if they can issue AP in Virginia

4. Or apply for AP in VSC and wait as long as it takes and move on

Please advice

Do it Yourself is my mantra...

1. Apply for it yourself. Form I131, copy of 485 receipt, 2 photos, check (go by INS website and not by the instructions in application) and a letter which can simply state why you need AP (To visit my parents)
2. No comment.

3. Yes. Visit INS web site and see what they say about emergency AP in the virginia ASC (field offices link). A trip to the ASC will not hurt. be prepared to go early and wait for the whole day. Take with you proof of ticket booked, a valid reason for the trip etc. If the 485 has been pending for more than 90 days, generally the AP is given without question. Emergency AP is for family based adjustees. But employment based adjustees can also avail this option. It all depends how far you can convince the IIO listening to your story.
