I485 for spouse 'out of status' for 150 days on H4
My wife was out of status for around 150 days while her I94 expired, being on H4 visa.
No sooner did we realise , she went out of country with kids and got her and their passports stamped with new H4 visas at US consulate in India.She has latest (unexpired) I94 , now.
Later,we applied for employment based GC under EB2 in Aug., 2004. We both are on EADs, now. I got I140 and I485 approved for me and my kids in May, 05 and have been asked to appear for FP at USCIS office. However, i did not get I485 approval for my spouse.I think her 'out of status' has to do something with this.
Does anyone know the fate of such issue? Will she be called for interview? Should lawyer join her, for interview ? We applied for EAD renewal for her, also. Will her I-485 be approved? How much more, we need to wait and what should we our next step?
