adopting a baby

We are lawful permanent residents and have a baby of our own. we want to adopt another baby from India. can someone shed any info on the process? will it be difficult to get the baby and if the baby does come here what is the INS process? is there any law that can prevent / delay the adoption process? i know in some states in India only childless couples can adopt babies.

Adoption In the USA

Hello Joef,

I understand that adoption from India requires one of the spouse to be citizen. But what about adoption here in the USA? We are both permanent residents.

We are considering adopting an indian baby from America is this possible for permanent residents??

Adopting a baby within USA can be done. We too are permanent Residents and in the process of adoption and found out its hard to get the baby Into USA.

In USA they are certain laws depending upon the state you live. Its very hard to find an Indian baby.But there is always a possibility.

Lets all of us who are thinking to adopt meet in these boards so that it may show us some light in helping each other.

why do you wish to adopt an indian baby? aren't all children god's gifts? why not give the gift of parental love to some baby of whatever ethnicity or race who could use it?
 
In order for an International adoption, at least one parent HAS TO be a U.S. citizen. US laws ONLY allow adoption of an orpahn from another country. There is a strict definition of an orphan. So you cannot adopt a baby from one of your relative even if they are prepared to relinquesh the custody to you for adoption purposes. You have to work with an approved adoption agency in the US who will find an orphan eligible for adoption from India. There also very strict adoption laws to be followed on US and Indian side and US immigration laws as well.

As PR's you can adopt any baby within US, but finding an indian baby for adoption in extremely rare and nearly impossible.

JoeF - What you quoted is legally correct. But as we all know that an International adoption involves adoption and immigration of the child as well. Therefore, PR's can adopt anywhere, but immigration of the child will not take place as adoptive parents cannot prove the custody of the child for 2 years and maintain their PR status at the same time. So therefore, an international adoption works completely only when at least one parent is a US citizen.
 
The two year helps those who have already adpoted the baby and living with the baby before becoming LPR (I guess)

Exception case is an LPR Can be on reentry permit for 2 years.
Stay in that country with the adopted child for two years,if one wants to do it and if this only issue stopping him than other stipulations,if any. (If in must have situation).But check the balance requirements whther they are inline.
