Adjustment through GC

a friend of mine is getting married to a GC holder, can he adjust his status through his wife .. or he has to Waite the result of his I-485 .. he applied for adjustment only 3 months ago (granted asylum 2003) ..

He can adjust through his wife, but she has to be citizen.

Do not do this because there will be a dramatic change to the asylee law shortly. The stupid 10K cap will be abolished very shortly allowing all asylees to adjust without waiting. So adjustment via a spouse will NOT be faster and you would face a much higher bar. Wait for asylee adjustment.

Adjustment through marriage to permanent residence doesn't make sense because it takes at least five years to get your GC. By the same token, if you are an asylee with ND earlier than May 2001, it may not make sense to adjust even through marriage to US citizen because, you would get your GC faster through your I-485 (asylum) than through marriage. BTW, getting your GC through marriage or DV or employement doesn't change the fact that you are an asylee.

I am pretty sure that in the coming 2-4 years getting GC through asylum process will have less waiting period than getting GC through marriage to US citizen (assuming that the REAL ID act is signed into law by very soon).
