Adjustment of status

Hello Everyone,

I have a H1 visa valid until Oct 2004. I also have an approved I-140 and EAD. I have not sent for H1 revalidation. Would I be able to sponsor a person when I am on Adjustment of status? I read from the websites that you can sponsor a person only if you have a valid H1/Green card/Citizenship. Is it true?

I would really appreciate your help.

you can sign an affidavit of support only if you are a citizen or a green card holder. You can only sponsor someone's immigration if they are a certain relative of yours and you are USC or GC holder.

Now, if you are married and you want your wife to get a gc with you, she should have been included on your I-140 and the it's possible for her to get GC as your derivative. But it's different from sponsoring somebody.

Thank you for your response. I am planning to bring in my mother-in-law over to US for a couple of months. Since my H1-visa would expire soon and I don't have the green card I am not sure if it is possible. My I-485 is still pending.

now you are talking about getting a tourist visa for you MIL, it's different from sponsoring somebody's immigration. you can simply write a letter, stating that you will finance your MIL's trip here, will buy her tickets, pay for her stay here, etc,. will make sure she returns to the home country, etc. Then you can attach copies of financial documents to show that you have enough money to finance her trip. You can also sign a I-134 affidavit of support to make it more official, but it's not really binding, although it looks nice. :)
 
You cannot file an affidavit of support on H1, EAD, pending AOS. As Lucy mentions, it is only on GC or citizen.
