Adjustment of Status & travel

Hello everyone,

My wife is a US citizen. We filed I-130 and I-485 together in New York City. I received a notice Saturday June 23rd, 2007 that the I 130 application has been approved. My question is this...I have to attend my brother's wedding in Canada this coming weekend (June 29th onwards). It seemed like I would not be able to make it for the wedding due to the AOS processing but now since I have received this approval my hopes have risen a bit. Is their anyway that I can go to the local USCIS office here in NY and get a temporary stamp on my passport, would they do it? I have not applied for advanced parole.

You should have applied for advance parole. Otherwise (unless you have a valid dual intent visa i.e. H1B) you can not leave the country.

The I-130 being approved does not give you any status with USCIS. It Only means that they accept that there is a link between your spouse for immigration purposes. You need your I-485 approved to have resident status and ask for a stamp on your passport.

However, You can make an infopass appointment to your local district office and request an expedited Advance Parole (travel permit) document. But a brother's wedding (which was planned in advance, I am sure) may not be enough reason for them to give you one. You can always try, but it sure looks very hard for them to give you one by Friday... :p

ps: you should have planned ahead.

I had planned for it. USCIS said nothing would be done on this case for 6 months at the earliest. My priority date is February 28th. I had planned to go to the wedding on my current status, but the processing moved quickly(not that I am complaining!!).

That's why I was wondering if there is any other way.

No problem. :)

My AP document was approved in 28 days! :D though I have not received it yet... but you can always try. Let us know how it goes :cool:
