Adjusting through US Citizen Spouse - want clarification on employment and overstay

Yes got our notices for 130, 485, and 765:

Filed July 22nd
Received notices in about two weeks
Completed Biometrics

Btw, did the paperwork ourselves and consulted with a very experienced attorney for couple of hours at $250/hour to review and as you suggested our case is pretty straightforward and she addressed how to handle any areas we were feeling uncomfortable with.

H-1 overstay since 2003 filed through citizen wife concurrently and awaiting interview date in October.

In the meantime my Indian passport is expired since last June and my consulate is willing to renew it conditionally for 2 years till I get my green card.

Million dollar question is, based on interaction with Indian consulate, they might be able to get me the new passport before October but just in case they don't is this going to be a big issue at the AOS.

I have not traveled outside the country using my "current" passport that expired last June. All my travel and US entries happened on my last two passports that the Indian consulate said I don't have to mail in for renewal.

Please advise as I would like to travel out immediately after my green card receipt and need to book tickets in advance for December travel.
 
It is very important to have a valid ID for the interview. Don't submit the passport for renewal until you get a state ID or driver's license.

You filed the I-485 in late July, so don't count on getting the green card in your hand by December. The published 5 month processing time is an estimated average, not a guarantee.

Fortunately I already have a valid California Driver's license.

I was thinking we should have the interview in October and Green Card latest by November if there are no complications based on folks experiences in the recent past listed on visajourney.com at the San Francisco Office and based on our lawyers suggestion.

I agree however, that we should not book tickets till we get the green card in hand :)

5 months is possible and realistic if everything goes well. But some people have delays for random and unknown reasons. And we are heading towards the Thanksgiving till New Years holiday season, during which many USCIS employees take vacations and there is a bit of a slowdown in processing.
