Additional Processing??

Delay at Vancouver re-valiadtion Additional Processing??

I went for my H1b revalidation to Vancouver last week, hoping everything would be smooth. However, the officer informed me that it would take some additional time (as early as 2 weeks but could be longer). They said they would call me on the cell phone when the processing is complete.

My paper work is perfect as it can be and no past visa problems of any kind.

So my question to the informed people of the forum is -

1. What could happen from here?

2. The officer returned my passport and 797. I still have a valid h1b visa for another 3 months and a valid I94. I hope based on that I can re-enter US without any issues? Right?

3. What happens to my H1 status in the interim? I hope my status is valid till my I-94, right?

4. What if they do not call?

Any help in this regard will be greatly appreciated.

Did they give you a paper that says 221g anywhere on the form and did they check any specific box for your information (Normally this is a yellow sheet of paper with boxes of various processing and clearance issues)

Did the VO tell you that you can return to US. Even otherwise, if your visa is not cancelled by stamping "CANCELLED WITHOUT PREJUDICE" and any such stamps, then you can come back to US. However, try at the border and if there is a question about you applying for a visa, try and be smart in negotiating by not revealing anything, nor telling something that can have something to do with your visa. If you are driving you may have better luck.

As your H1 is expiring in 3 months time, did you apply for an extension? If not you should do right now.

3. What happens to my H1 status in the interim? I hope my status is valid till my I-94, right?

You H1 status will remain valid till the date stamped on your I-797 and the I-94 on I-797 is equally valid

4. What if they do not call?

They will certainly call you. The question is when (2 weeks or more). It is not a problem. Wait out the time and your visa will be issued. If you happen to come back to US visit the forum and share your experience once again. Good luck

Do not worry about any processing issue, all the clouds will clear up sooner or later and your visa will be issued until the last day of I-797

No, nothing. While returning the passport the officer stamped the last page which reads as "Applied at Vancouver on Dt" and he wrote some number by hand. "221g" Not sure what it means.

No my visa is not cancelled. I still have my I-94 and I am driving.

No my visa is not cancelled. I still have my I-94 and I am driving.

Hi,

You are quick at reading the post and even replying. Kudos for your bravery. Here's my suggestion and that is what I would do myself

Keep the list of names and numbers with you and do not call the border posts, as they keep track of all tel calls and the like

My understanding is if "221g" is written on your passport (even if it is not clear) then you may have a hard time crossing the border. However, if you negotiate at the border then you can be through. Try you luck, no harm in doing that. At best they will ask you to return back to Vancouver.

Oh I am sorry.
Actually I was given a paper which states 221(g) and in the differrent reasons listsed the last one (n) is circled "Others" . By hand he has written "Further Processing".
Not sure what it could mean? Or how long it could take.

Hi Napolean,

There comes the cat out of the bag. Anyway all we can do is guesswork as far as further processing is concerned. May be somebody in the forum who has had similar experience can write what that means. I had some other issue when I went for stamping. Are the words TAL listed anywhere on the form, if not this may be the reason.

Hopefully, the time taken (for further processing) will be short and I'm sure you will be cleared very soon.

Do you plan to stay in Canada or are driving back to wherever you are residing. Good luck and good wishes to you for everything.

Further processing is another name for background-check/administrative processing/security clearance that some candidates have to go through because of false name hits. you can read more about it, how to find out your status, as well as experiences of other people who have and are going through this ( including myself) in this post:

If you have applied at consulate then never try to cross the border. Even if they allow to come inside US don’t enter. By law you are not suppose to come back using Automatic Visa Re-validation (AVR rule). If you do so, your presence would be illegal and in future (GC time or H1 Extension time) you are more likely to face issues. My advice is to stay out of US till you get visa stamp.

But I have a valid (unexpired) visa and a valid I-94, I also told the border post officers the whole story.
After some discussion amongst themselves they let me in.
Can you please point me to some government resource where you saw this information?
 
They let my friend in

My friend's has the same issue,

His 221g is still under processing 2 months old. He crossed the Border using I94 + AVR (assuming)

Any thoughts.

Hi,
You dont have to stay out of US since you were legally allowed into US by the custom officials. This has happened quite a bit (I was hit with the same clearance in india, but during that time quite a few people in mexico and canada were allowed in after getting hit with clearance checks). You definitely are not in illegal status etc.

So, relax and when the visa is ready, go and get is stamped. In india I was stuck for almost 3 months...

I was wondering as to what happenned finally. As there is no post from ur side since July 20th 2006.

Did they finally call you from Vancouver consulate and you went back for stamping, If yes, after how many weeks / months you were called again?

Pls let us know ur experience while going back and getting ur Visa stamped finally, if this is what happenned!
