Hi all,

Has anyone attempt to get AP from local Boston office? Can I do apply there?

Please advise.

Thanks,
Sandeep

I had a bad experience in Boston INS office. Eventhough my I 140 and EAD were approved after an RFE, as my wife had to travel when I went to get an interim AP they rejected the application. We even showed her airlines ticket.

Heard from someone that they issue only if its real emergency.

Good luck

Sorry about that. I am also planning to go soon to ask for AP, as we got married recently and I added my wife as dependent and started her AOS processing. I booked my tickets in November and we are still waiting for her AP. What do you suggest regarding my case. Please help...

Sorry to talk in between
Do you have H1? I suggest using H1/H4 rather than AP. So many countries are asking for transit visa. Not safe before I-140 approval

thanks tammy2
actually my lawyer did not suggest for renewal of my H1. And my wife's status was F1 and we both got married. After our marriage, I applied for her AOS. Now we both are planning to go to India.

Please suggest a way, as we have to go to india in Nov.

Difficult. You have to use AP. But other way is applying for new H1 and getting it stamped before coming here. When did your H1 expire? Write details like RD ND etc.

AP

All

Can I get my passport stamped (re-validadted) within US after entering US using my AP.

I have my H1-B valid till 2005, but my VISA in passport expired this year.

question to mdu123

hi mdu123,
you said in your previous post that your wife's application was rejected. Did the local office reject her AP application? Or just denied your request to give an interim AP? I am confused.

Thanks

My wife's interim AP was rejected as I had an RFE for my I140. Later thru normal processing she got her AP in another 2 weeks.

thanks mdu123

thanks for the info. I am planning to goto Boston local office next week. Could you please suggest me what documents do I need to take with me? Any tips?

Thanks again

These are the documents I carried.

1. I-131 Application for Travel Document
2. Attachment to Form I-131, Application for Advance Parole. (My attorney sent it to me. If you don't have one, they will be giving you when you enter BCIS office)
3. Copy of the receipt of I-131. (If you had applied one already else the fee for the application)
4. Copy of the receipt of I-485.
5. 2 Immigration type photos. (You can also take them there, I think. I saw many taking there. I don't know if its for AP also).
6. Proof of travel - Airline ticket, emergency reasons etc. (I heard Boston office issues AP or I-AP only for emergency purposes)

Even when my I-140 was approved (after an RFE) and we showed the tickets, the officer refused to issue I-AP to my wife. So please check before you go. Its really frustrating to wait out of the building in the chillness for an hour or two to get an early number and then get rejected.

Good luck

question to mdu123

Hi mdu123,

sorry to bother again. I already applied for my wife's AP earlier. For her Interim AP, do I need to pay the fee? If so, in what form? Do I need to get a money order drawn? Can I have these details, Is it possible to contact me at propatpropat@yahoo.com. I appreciate your help.

Thanks
