Few days back I got a letter from NSC that they are "actively processing my case", detailed review etc..... Today the Senator office staff told me that my NC is still pending and it was requested by USCIS in 2004. The status from Senator office was after the letter. So, my conclusion is if you get a status such as the above that may very well mean that NC is still pending.
