Ac21 ??

Gurus,

Just wanted to find out what is AC21.
Do I need to file this if I join a new job. I was laid off a few months ago and now have an offer. I have an EAD valid till Mar04.
Do I need to file something with the INS or can I just start working for this company on my EAD.

Your responses are greatly appreciated.

Its NOT mandatory that you should inform BCIS if you change jobs using AC21 rule (the rule that allows u to change job after 180 days of filing I-485). You can inform if you prefer to. Write a letter to BCIS stating the job change, new job description, salary, offer letter etc

As long as u have a valid EAD, u can start working for the new company. Hope u already completed 180 days after filing I-485.
 
You are not REQUIRED to inform BCIS about the job change. Briefly, AC21 allows you to leave your current employer and join a new employer provided the following conditions are met, among others:

1. You worked for your original employer (who sponsored your GC) for at least 180 days following your I485 filing.

2. The new job you are accepting is SIMILAR to your old job. For example, if your LC was certified as a software engineer and that was what you were in your last job, you cannot join another job as a stock broker.

I hope this helps. I suggest you talk to an attorney. Usually they charge $100-$200 per hour for consulting. It is worth paying that fee in a situation like yours. BCIS has not officially issued any guidelines for lot of the AC21 provisions, so much of it is very subjective and open to interpretation. So it is not so simple as lot of us think it to be.
