I just printed this AC21 memo. It is not unclear. The only point it
says about this 180day rule is to have the new job in same occupational
classification. Here is how I interpret it. ( I am not an attorney so please ....)
1. You should have copies of all your applications. Labour, I-140 , I485.
not many people have this for whatever reason. This will make you and
your new lawyer confident about what you are doing. check this site for the
fillable forms, you will know what is needed.
2. Job title does not matter. what matters is the occupational classification. Occupational category is mentioned in your applications.it is also available at the DOL publications, INS will consult DOL publications for this.(memo says that) eg. On wall street your title is VP but your job is analyst/programmer..
3. if current employer cancels your I140,which he would in agony, memo says that, you will have to get letter from your new employer stating the new job title,salary,job description. If you have your labour you can match it with this.
4. it also says to consult HQ on case by case basis before denying the case.
5. this will take another couple of months right? so calculate your odds....
