AC21 without I-485 filing

Hi,

I did I-140 based on Perm approval (2006) and I can not file I-485 as dates are in 2003.

If my I-140 gets approved can I change the employer - for the same job or do I have to have I-1485 filed for more than 180 days ?

Concept of AC21 is for those who filed I-485.

If you want to change, your new employer must file for new labor, then new I-140 and you would be able to carry your current 2002 priority date. When the date is current you can file 485.

--------you become eligible to use AC21 if I-140 approved AND I-485 PENDING more than 180 days.
