AC21 Twice Impact

I know this question has been posted several times on this forum, but I wanted to know if anyone in this forum personally used AC21 twice to change jobs?
I am EB3(India) with PD in early 2003 and I already used AC21 once.
Recently there is an article on murthy.com about AC21 and the implications of using AC21 more than once if INS comes up with a much stricter regulation.

If anyone in this forum personally used AC21 twice, can you please share your experiences / thoughts? I think this is a very common topic these days that helps many of us.

I know someone who changed jobs thrice and got approved.
There no reason to inform CIS of the job change if your PD is retrogressed by few years, you might change the job again!

Thanks for the response. If you change from city A to city B then ofcourse CIS needs to be notified of change of address in which case I would imagine that CIS would know about it. whether they care or not, thats what i dont know.

I really wanted to see if there is anyone in this forum who has already done that so i can get first hand information.

Is it allowed for one to pick up a second job while pending for I-485? The main job at the company that applied for the GC is still the primary one but what if one wants to start a second/part time job? Thank you

You can start second, third or n-th job in any field as long you have a primary job in the same classification as your LC/140 was approved for. There is no requirement to file AC-21 for part-time/secondary jobs.

Thanks for the reply, Armie. This chat group is AWESOME! :)

Maybe its obvious.... but to add to what armie said, you also need to have a valid EAD to do more than one job ;)

H-1B or L1 won't work !

use AC21 for lower wage but same level job

Dear friends,

I am working on EAD to state gov as contractor. They(state) have opened a full time position for me but offering low salary. Whether I can take this postion using AC21? Since the salary is less than what I am earning now, is it compatible at immigration point? I appreciate your help.

Regards,
vakasree

Vakasree,

Only thing that you should make sure is that you're not paid less than the Prevailing Wages. As long as your salary is equal or more than the prevailing wages you're fine. If it goes under then you have a problem ... other experts may comment on this.

Thanks

Thank you thukralrk for your timely advice! Do we have any source of information on salary constraints for AC21? I really appreciate a reply if anybody has.

Thank you all for the help!!

hi vakasree,

No salary constraints for AC21. Just make sure that you are getting more than the prevaling wages mentioned in your labor.

Satgym,
Are you saying that if the labor prevailing wage in the LC is 50K and you take up a job now for 90K, thats not a Problem?

50k in SC = 90k in NY
There are no salary limitations on AC21; however, the salary difference should not be too much to invoke suspiscion the job functions are entirely different from the original LC.
