AC21 software development to consulting

I'm currently a software developer just tired of the amount of work and the management. I could move to a position doing consulting, keep my salary, stay with my company and keep the same lawyers. I would be developing custom-applications instead of the generic software I currently do, but it would still be some sort of software development. Would that mean a job-description change?

But I have no worries about losing my present job, so should I just suffer a while longer perhaps? Any advice is really appreciated.

In my opinion, if you have a luxury of keeping your current job (with the original Green Card petitioner, I presume), just hang on there until you get the Green Card and for 6 months more after that. Considering your I-485 RD, it won't be long until your turn comes.

Then you can do pretty much whatever you want. Even deliver pizza or wash cars, if it is your lifetime dream.

Should not be a problem - just for good measures verify your ETA 750 form that you are not restricted by any means.

I dont see any problem. As I understand even though you switch from a developer position to consulting position you will be using same programming languages and tools as specified in I-140/ETA.

There are two ways of doing it.

1. Using AC21 to move to this new job, making sure the job duties and requirements does not change much.

or

2. Go to the consulting postion without using AC21 and but make sure your company gives the EVL for developer position if there is any RFE. Remember, the GC is for the future position, so you need to take the position of developer once your GC approves in this case atleast for 3 to 6 months.
 
I would wait till 485 approval. The processing seems to have picked up, no point in risking everything you have worked for on the whims of your case officer.
 
Thanks for the replies, I appreciate the advice both for and against the move. I'm going to wait sadly because I'm too chicken to move jobs :(

And I had no idea I needed to work 3 to 6 months even after GC approval...darn! I've been dreaming of handing over a resignation letter for so long.

BitterMan it's funny you should mention carwashing and pizza delivery, I always tell friends "with approval I can quit and work at Mc Donalds" and some look at me as if I'm nuts and I have to explain that while that's not my dream what I mean is it would be great to have the freedom to do that.
