Ac21 - Simultaneously on payroll of 2 companies.

Hi,

I have to take up a permanent job next week, but it's only 160 days since my 485 is filed. In order to eliminate the risk of company withdrawing 140 before 180 days, I am planning to take vacation(paid leave) of 2-3 weeks from the present company and join the new company immediately. And then resign form the present employer after 2-3 weeks( when 180 days are over). My concern is that is it legally ok to work for two employers simultaneously. Since I would be taking paid leave from present employer.
I am not able to get start date extended and also I am sure, that present employer won't help me.

Pl. advise.

If you take paid leave for the present company then you will get paid, so you will be getting pay stub that meance you are with that company for 180 days correct ?

than you will be eligiable for Ac21, I think with help of EAd you can do multiple job, like work in week end (which is similar to paid off days)

If you will get unpaid days off then it will create complex situation.



I would suggest try to keep good relationship with your present company as possible, because withdraw of I-140 after 180 days might create problem as Ac21 has lots of gray area.

Is keeping both the job is an option? may be Full time, part time, W2, 1099 with EAD

Can you work in both jobs full time? Legally yes. physically- dont know.
The only requirement is that one of the jobs should match the one described in LC/140. Information about the other job is totally irrelevant to BCIS..
