AC21 Re-Sponsorship Letter

Hi,

Need some thoughts on how to proceed with the AC-21.

I am considering a job with a state government agency in california. They are OK with me working there with my current EAD. They will issue a employment verification letter and provide pay stubs and the rest.

But they cannot issue a GC sponsorship letter to the BCIS - on my behalf.

Is it OK to submit to the BCIS - a letter myself - informing them of the job change with the EVL and Pay Stubs.

OR

Does the state government agency have to provide the letter ?

My current status is:

Employed with the curent employer since '98.
I-485 Applied in May 2002.
1st RFE Received last month for Employment verification and was promptly provided to BCIS by the company attorneys. No updates since then.

------- they have to provide future permanent job offer letter in same/similar job duties as on approved LC , if they dont provide you cant use AC21

------ NO your letter will not work, you need future permanent job offer letter

Does the state government agency have to provide the letter ?
------ Yes they have to provide it if they need you permanently after I-485 approval

----- It seems you may get I-485 approved in short time and it will be for employer whose letter you submited with RFE

You are good to go. What you really need for an RFE is EVL and paystubs.. don't worry take the offer if it is good.. you don't need any sponsorship letter.
