Hi All,

I have few questions on AC21

1. I am changing employer after 180 days of my I-485 filing.
2. My new employer's attorney says, he will draft an AC21 letter and I have to send that to USCIS. The new attorney will not send any G-28.
3. Will it create any problem in my GC process ?
4. in the event of any RFE generation, will it go to my OLD Attorney ?
5. How my Family's GC process will be affected ?
6. Do I have to engage a personal attorney ?

Thanks

howlong2000,

Strange that your new lawyer does not want to file G28! I would think that is the first thing they do to justify receiving your money.

If he refuses to file G28, maybe it signifies he doesn't want your case. You can always hire your own lawyer and go through him, or hire your old lawyer, in which case there is no need to file G28.

As far as AC21 is concerned, I wouldn't file it unless it was absolutely required. IT is always better to wait for RFE and THEN send EVL with AC21. Apparently cases these days are getting approved without RFE, so it might be good to keep your case as simple as possible till it is adjudicated, and at that time, if they want EVL send them AC21, if they don't then forget it and wait for approval notice! :)
