AC21 problem file transfred to Baltimore

Please help me, I am new to this discission group

My I-485 file has been transferred to Baltimore on Feb 3 for Interview (according to BCIS online status)
My I-485 was filed with VSC July 2002

How many days it takes VSC to transfer the file to Baltimore?

Usually how long should I have to wait to get the interview notice after the transfer (Your guess)

When will be my interview conducted at Baltimore Local USCIS? (Your guess)

I have other problem I changed my employer after I-140 approved and I-485 pending more than 180 days with H1 transfer and I still maintain H1 with new employer. I was ready to send the future permanent employment letter from my new employer to use AC21 to VSC but I-485 file got transferred to Baltimore. Can I submit the AC21 or new employer letter at the time of Interview? Or I will expect problems?


My new employer also filed LC as back up and that was approved in July 2003 and new employer also filed I-140 with NSC that is still pending.

I Maintain H1 status at this time.

I hope you can give new employer future job offer letter at the time of Interview.
I think you are safe as your new employer also filed new I-140. I don’t know how the Baltimore office work and when they can schedule the interview I remember reading that some time back VSC transferred many files to Baltimore and all were interviewed in 2-3 months. i read that at that time Baltimore asked VSC to give them some work.

Did your new employer also filed new I-485 with I-140?
Or did the new lawyer of your company interfile the new I-140 to be attached with pending I-485? If that would have been done then I don’t think your file should have been transferred to local Baltimore office so early with out your new I-140 approval.
Others may give you a good guess about interview date

I can't tell you when your interview may happen- that is anybodys guess.
But you certainly can provide the job change papers at the time of interview- without a problem.
Also new LC/140 etc is of no use- completely irrelavent- somebody simply had too much time/money etc to spare.

If you did not notify NSC about your employer change, how did they know that? I also moved from NSC to Vermont without filing AC21 and I am waiting for RFE.

--------------- Filing new LC and I-140 is not irrelevant if they try to deny the I-485 based on previous employer I-140 then you can immediately provide the new I-140 filing receipt and they can not deny the I-485 and your I-485 will be pending till the date your new I-140 gets approved or gets denied. If new I-140 gets approved just sent them the copy of new I-140 approval and you will be fine and in this scenario no AC21 will be used and I-485 will be approved based on new I-140. You are safe

-------- The poster had pending I-485 with VSC and new I-140 was filed with NSC and poster did not inform VSC about employer change, She can update USCIS at the time of Interview, she may have joined new employer with H1 transfer and may have not updated VSC about job change and the file is transferred to local office due to many reasons, I don’t know if she also filed new I-485 with NSC. If VSC I-485 gets denied due to any reason (very less chance of denial) the poster has other I-140 and I-485 pending and will be safe. Many would like to be in the same situation at the same time and it is a good back up plan
