AC21 - Portability issues

Hi,

When I140 is revoked (after 180days of filing I-485) whether INS will notify about the revocation? Do we have to restart the process of I-485 with the new employer?

if I-140 is approved and I-485 pending more than 180 days you may get RFE or NOID if you you have not used AC21. if I-140 is revoked/withdrawn before I-140 gets approved then I-485 is denied.

AC 21 - Portability Issues

Thanks a lot ginnu!! I-140 was approved during September 2003. I-485 was filed on January 2004, -3- months after approval of I-140. I have joined another company in the same position during July 2004 (after 180 days of filing I-485). So far I have not received any RFE or NOID from INS. My EAD and Advance Parole are issued and renewed. When I tried to reach the INS customer service through phone to know the status, I am getting a recorded message saying 'Due to temporary problems we could not access the status of your case'. I am getting the same message for the last 3-4 months. I am a bit concerned about this and contacted the attorney (old company) He is saying that my old company has revoked the I-140. What would be worst case scenario that can happen for me? Please give your thoughts.
