AC21 Portability - apply to "Multi-National Manager" category

Hi:

I filed I-485 in June of 2006. The case was just transferred to Lincoln, NE like many other cases pending in CSC.

I am very unhappy at work and think they are taking advantage of me, knowing my immigration status. My immigration was filed under the "Multi-National Manager" category and did not go thru the regular Labor Cert route. My question is, am I still eligible for the AC21 portability rule? What's my risk if I change job?

So long as the criteria below are met, you can change jobs with minimal risk:

(1) i-485 pending for 180+ days
(2) i-140 is approved
(3) EAD approved
(4) New job duties are identical or similar
(5) Ideally the job title would also be identical or very similar

It's EB1 category....multi-national manager....

Yep, AC21 applies to all....be it EB1 or EB2 or EB3....one can shift jobs as long as the new job is similar to your current job...
