Guys. I will be completing 6 months on I485 and am thinking abt using AC21. I do have a few questions and would appreciate if you couls post ur comments.
My details I140 has been approved. H1B is valid till Oct 2006 .EAD /AP approved but not used yet.

1. Can I work for a small company with 30 odd employees as a consultant with same job duties etc .
This is a small company and I will be working as independent consultant except that I will be full time with them till the project lasts. Some of the things that concern me are
(i). I will need to let my H1B go and work on EAD. I guess lot of people have done that though .Is my assumption correct.
(ii).Do I need to make sure that the company I will be joining will have ability to pay. If so how do I do that ??. I am meeting the guy on Thursday. Please suggest.
(iii). I have friends who have done this meaning they have become employees for companies only till the project lasts, and I plan to do somwhat similar.
(iv). If I have 3 months no salary (say I am on bench), will that be an issue.
2. all in all if this route I am taking full of risks. Should I avoid this and wait till I get my GC. I am thinking abt taking route 1 since that means abt 70-80% more money for me.

1. yes since it is consulting company make sure you job title and job description are the same as your approved LC.

2. Well.. make sure they have enough profits and turnover for past few years. usually if it is 30 guys and all of them are on projects then the company should not have any issue regarding ability to pay.

when your on bench hopefully CIS won't ask for paystubs..

It is upto you the way i see it is as long as you have project i think your ok
or if you can get projects pretty quickly then i don't think it is an issue. But it is upto you ..

say if ins asks for paystubs and i have been on bench, does that mean a denial. i mean isnt gc for future fulltime job. does it matter whether i am not getting paid right now. also if i can find a company which will give me that letter and intend to employ me when my GC comes is that ok, then i can work for anyone meanwhile.
 
yep GC is future job. I didn't mean that if CIS asks for paystubs and if you on bench at that time then it is automatic denial. Yep it should be ok if you can get a letter from a company that they willing to hire you after I-485 is approved.

I would consult a lawyer on paystubs and bench issue even though you can provide a letter that in future you have an Employement offer.
