I am planning to invoke AC21 next week, looking at the AILA website the latest report for NSC I485 is 06/04, so looking at this I am held back and thinking not to apply for AC21.

I think U are doing right thing.. Wait till Sep 15th when we will get the exact picture regarding the cut off dates etc...

There is good chance that you get 485 by Oct - Nov...

ND/RD(EAD2) - 05/2005
AD(EAD2) - 06/2005
AD(I140) - 05/2005 :)
BM-code2 done - 08/2005

It depends --- are you from one of the retro effected countries ??
I see that your PD (11/2003) is nearly 16+ months away from the last published PD cutoff

So even if NSC is processing 6/2004 cases, you will be hit by retro (depending on your country, of course)

Yeah - wait till mid September and then u'll know the status of eb3 worldwide - maybe they'll put a cutoff for all eb3 applicants this time - who knows !

Hi Gurus,

My 140 approved last week. My Labor PD is August 2003 (LC approved in EB2 category), but my 140 got approved in EB3 category. I applied 485/140 on October 2004.

I am in the process of getting another job through another company. Should i need to file AC 21?? Also i will go permanant to another company by Jan 2006. Whether i need file AC21 twice?? Please help me in this regard.
