Hi Gurus..I would really apriciate if some one has anwser to my questions.

I getting this opportunity to earn some extra money by working part time in an IT firm(after 6:00/Week ends about 15-20 Hrs.) along with my permanent job.

Is it okay to work like this on AC21 or is it going to be a problem with USCIS?

Thanx in advance!

No need of AC-21 as long as you keep your original job. This an addation job which you take on EAD.

Yes, this has nothing to do with AC21.

Just use your EAD to work for the part time job and you'll be fine.

But remember, once you use your EAD you're no longer on H1B. It becomes invalid and you will need to use the EAD for ALL jobs from now on.

This shouldn't be a problem, though, as long as your 485 is not denied.

Thanks guys for the response. I already working EAD my H1 is expired longback.

It's just too much hassle to keep renewing H1/EAD/AP for my self and whole family. so i decided to switch to EAD.

Is it allowed to start a company on EAD; For eg: Can a spouse start a company and work for the company using EAD?

Yes. There's typically no requirement of any particular immigration status in order to start a corporation.

Can a person waiting for 485 ( with EAD), start a corporation ( Inc, S or C type) or an LLC?

Are there any restrictions, like only a US citizen can start a particular type?

Thanks.

What about working for it? Can EAD be used for working in a company started by yourself?

Just a last clarification on this. So, If I understand it right:

1) Since you have an EAD now, start a corporation; In H1/H4 status, starting a corporation was allowed but working for it was not allowed.
2) Start using your EAD for both your sponsoring company of your original job and for working for your own company.

If one uses the EAD for one of the two jobs above, automatically the original H1/H4 becomes invalid, requiring the EAD to be used for all the jobs. Correct?

Sure. The only restriction is that your own company cannot sponsor you for AC21 purposes.
