AC21 job offer question

I am trying to join a new company invoking AC21. Salary and title are fine but the new company is a software gaint, willing to take me on EAD but says it will give only a standard offer letter without the special LC wording I requested. I am concerned that I might loose the offer if I push them too much, I have applied to this job as a response to the company's direct internet ad. Can I use this ad. in addition to the offer. How important it is to have the LC description in the offer.

----------- if they list the job title and skills as on LC then no problem. you can post the contents what they are ready to write on permanent job offer letter so that others can guide you if the letter can be used for AC21.

currently, i have only the verbal job offer. it would take sometime for the company to offer me in writing. i discussed the possibility of having LC wording and the response was negative. I did not go in further details after that. since they said its a standard offer letter, i doubt it would have my skills in it even though my new job duties would require the same skills as the old job. title is the same.

i will post once i receive the written offer and then i can consider AC21. thanks.

It is not necessary to know or match the exact duties in the LC. The important thing is job classification should be same. Do not waste time in FIOA. Get help from Onet and get a letter from current employer to have the job duties listed briefly, to have the actual job functions and it should be in line with Programmer/Analyst as per O.net.

i'm also in the same boat. my new HR did not give me a offer letter with job duties/skills mentioned in my original Labor. If my manager gives me something in writing about my skills and duties, would that suffice, incase of any query from USCIS in future. I'm trying my best to get the letter from HR before I join the firm in the next few weeks. Please guide me.

I could convince my new company HR to send a separate same/similar job duties letter to my attorney directly rather than to me. That made the HR very comfortable because now they are very sure that I will not legally abuse any such letter.

Positive4GC, you can also try the same route. Attorney says he will draft the letter and send it to new company HR.
 
Same situation here ! Imagine employer doesn't want to issue AC21 wording

Guys I have a potential job offer. New potential employer doesn't want to get involved at all with the greencard, lawyers, etc thing.

Therefore I predict I would be able to get a very standard Employment Evaluation Letter "To Whom It May Concern", listing my job title and brief job description (I can try to sneak in similar language used on ETA 750). Let's say that is the case and no AC21 wording is listed on such letter. Do you think that should be OK ?

Here it is how the letter would look like:

<New employer letter head>
To Whom It May Concern:

This is to confirm that <Harikishini Banghishin no seu bish> has been employed since <date>, as a <JOB TITLE>, salary < >, full-time.

His job description is <O'NET job description for network and systems administrator here>.

THAT'S ALL !

Signature of HR person



Is that enough ? It appears to me that should be the case !
Note:I am just replying to I-485 RFE from current employer. Perhaps that means that after reply to I-485 RFE using sponsoring employer, that perhaps would be even a better time to move on ?!

o*net is part of the DOL, it lists all the job titles and job duties for the DOL defined jobs.....might be helpful in drafting the letter for sending AC-21 docs...

This is the part that I can't understand; there is no such thing as 'permanent' employment. The vast majority of jobs in America are 'at will'.

----------------- GC is based on future permanent job Offer. USCIS need words that it should be Permanent job offer. you can ask the USCIS/your lawyer for more info so that you can understand it better.

In my case, attorney said he would prepare the portability letter after going through copy of labor, O*NET, and the offer letter. Did you talk to your attorney ? Tell HR that its just a letter about only facts, try talking to your boss whom you would be reporting to. HR would listen to them.
