AC21 JOb Classification Help!

AC 21, Job classification help!

I filed my labor under DOT codee -030.062-010, SOFTWARE ENGINEER. Now I am offered a position of Programmer Analyst. DOT Code: 030.162-014. Salary is almost similar.

Will the above position be classified as same of similar job and qualify under AC21 Portability law?

Its more than 180 days after filing i-485, and 140 Approved.

I dont know if you are joining with H1 transfer if join with H1 transfer then only the Future Permanent job OFFER letter should have same/similar skill, GC is for future job not for H1 job and H1 job title has nothing to do with Future permanent job offer letter.
If you join with EAD then better let them write the future job offer letter with same skills as on approved LC and Job title may not create any problems i have seen few AC21 cases with diffrent job title approved.

** you can contact your new lawyer and ask him what he /she says and let the lawyer draft the AC21 letter and send YOUR intent change letter
 
I would be making the change using EAD and not H1B

----- If possible change job with H1 transfer and being on H1 has advantages for you.
It us up to you to join with H1 transfer or with EAD, If with EAD then you need to have valid AP approved IN US before you go out

GC is for future Permanent job and new employer has to provide you Future Permanent job offer letter and that letter of offer should have same/similar job offer as on LC to use AC

Take the print out and read the AC21 August 2003 MEMO and try to understand it fully
