I am planning to take a permanent offer as its going to be 180 days on my 485 application. I have the following questions.

1. Do i need to have a copy of the LC.
(I have a copy of 140 receipt(140 got approved only last week), labor approval notice(just 1 sheet), Receipt notice of 485, AP and EAD).

2. Can i take any other consulting opportunities or only permanent offers.

3. Are there any words that INS looks for in the employement offer letters in specific. viz "permanent" etc other then the job title and salary.

4. My labor approval notice states that the job description is Programmer analyst. Does not say anything about what kind of work etc. IF the new employement offer letter says job is programmer anaylst is this sufficient or should there be anything else.

5. If my current attorny does not provide me with the complete information or documentation , is there a procedure that my new attorny can follow to formally request for necessary documentation of my case.

I guess this should help many of us who are contemplating on AC21. If i am missing anything , people plz feel free to add into this.

Thanks

hemeshd, jaxen,

Since hemeshd got his i-140 approved just last week, and this is a case of concurrent filing, how does one calculate 180 days. I have read at many places, where 180 days is calculated from the approval of i-140.

In the case of concurrent filing, to be safe it is adviseable to count the 180 days from the date the I-140 is approved.

That also seems to be the stand taken by at least one od the BCIS service centers.

180 days is from RD of 485

In My opinion the 180 days should be counted from RD of I485 and the only additional requirement to jump ship is that I140 should be approved. You need a lawyer who can argue this out if you ever get a RFE or denial.

1. Yes, it will help the lawyer if you have the copy of LC and the copy of the application
2. You can take other consulting opportunities (use EAD everywhere) but atleast one job should be based on the description of GC and permanent

3. Not necessarily. But the job description has to match the LC description, and there need be a notion of permanence.

4. Look up http://online.onetcenter.org/ for programmer analyst
5. Yes you can demand all the documents thru your new lawyer

Jaxen and everyone thankyou for all the input. This really helps everyone who is contemplating switching companies.

Thanks
