AC21, Implications for citizenship.

Hi all. I'm a new poster although I have been monitoring this forum for some time.

What I'd like to know is if anyone has had advice concerning the implications of AC21 for naturalization?

My attorney previously stated that you should stay with your sponsoring employer for 'at least 6 months' following I485 approval. The reasoning was that this proved 'intent' to work for the sponsor and that this would avoid suspicion of your motives when subsequently applying for citizenship.

In light of AC21 and the 180 day rule, does anyone have any idea how BCIS would view AC21 users during the naturalization process who have changed employers prior to I485 approval?

Given that AC21 exists it would be nice to think that naturalization would not be difficult but has anyone ever been advised that they are putting their citizenship application at risk by using AC21?

As pointed out by many people, AC21 or changing job too soon after GC affecting naturalization is purely rumor and totally unfounded. And you have many other things to worry about than that before you get your I-485 approved.

I'm not sure that this is purely rumour and unfounded. Why else would my attorney raise the issue?

I don't believe anyone considering AC21 should ignore the possibility of problems if they have ambitions to become a citizen one day.

Lets hope it becomes clearer once the AC21 rule is published. Until then I accept that we are all just guessing.

Using AC21 should not cause any problem, because it is law. Change employer too soon after GC may raise suspicion, if that is the case, you can still get a good lawyer to fight for you.

I have read several posts by those who just became citizens and they said no questions have ever been raised about their employment after they got GC even they changed jobs a few weeks afterwards.

Some attorneys interprete the law based on their own understandings: employment based GC holders should have a good intention to maintain the "permanent positions" for at least 6 months. If you want to feel comfortable or "safe", just follow their instructions. 6 months is a short time. However, I don't think there is anything to worry about if you have to change job soon after getting GC.

changing job after green card

Even after the GC is issued we are required to keep BCIS updated with our current address.
Perhaps there would be a risk in changing jobs before receiving the actual plastic card even though you have been approved and have your passport stamped. After the plastic GC is issued, I doubt that they would pay much attention to an address change.
