I'm guessing that there might not be much information on this but does anyone have a feel for how similar a new job has to be to the one for which the I-140 was approved? Are there any guidelines that I could refer to that people are aware of?
I'm specifically wondering about IT (programming / software engineering) positions.
For example, in the hypothetical situation (not my own) where someone is sponsored as a software engineer (EB3) for a job which involves programming for some specific area within the telecommunications field, what would the options be for switching to another job under AC21? Could this person take on any software engineering position, any programming position in the telecommunications field, or would he/she have to find a job doing pretty much exactly what he/she was doing previously (e.g. writing Java applets for cellphones or something like that)?
I've seen some posts suggesting that there is some flexibility under AC21 but I don't have a feel for just how far this can be stretched...
Any thoughts / feedback on this would be much appreciated.
