AC21 - help appreciated

hi - my receipt date is oct 09, 2001. i got an rfe for bc and INS received response to rfe on nov 12, 2002. still waiting for approval. my current project is coming to an end on dec 31st and i'm afraid of layoff after coming on bench. but i got another offer from a good company ready in hand. they want me to start from 20, jan 2003. is it good to use AC21 to switch the company? is my GC in jeopardy if i take up this new job? pls help
 
Legally you can use AC21

You are well past the 180 days after I-485 filing, so there should be no problem in changing your job. HOWEVER do consult a lawyer.

I myself am thinking of changing a job using AC-21 soon. As far as I have heard , AC-21 poses NO problem at all...some people get RFE, not sure what will happen in your case, since u already got an RFE (BTW what was that RFE about?)

Usually the bg decision to make is whether to inform INS about the job-change or not. Some people do, some people don't, each has pros & cons. Even some lawyers recommend it some don't, it'd be best to consult a competent lawyer with the details of your case. He/She'd be able to suggest the best course.

RFE was for bc

thanks for the information. the rfe i got was for birth certificate. to think of another rfe is scary. i like this new company v.much. but at the sametime, not sure if my current employer could find another project for me soon. i'll better contact a lawyer to get more information about this. thanks a lot and i appreciate your help!

I have a couple of questions for you. A response is appreciated.

Can you provide some info about the RFE you received for birth certificate? What info did INS want? Did you file a valid birth ceritficate with your 485 application? If you had not filed one how did you respond to the RFE?

The reason I ask is because I'm expecting a RFE about my bc too. I have not filed a valid bc with my 485 application. Because my actual dob and the one on my passport are different. All I have submitted are a bunch of birth affidavits from parents and uncles. Nothing from the local authorities either. I hope there wont be a RFE, but you never know.

I have filed a valid bc with the I-485 application but the bc that was offered by the municipal corp does not have my name on it. It only has my parents name on it and they got the certificate too early even before I was named. I also got an affidavit from the Consulate embassy in NY and submitted along with this bc. But, INS still wanted affidavits for proof of my birth from my parents/relatives that is also notarized.
