AC21 elgibility

I filed my labor under perm and got cleared on NOV2005 and 140 in October 2006 . I would like to know if I am eligible for AC21 at all or is AC21 suitable for concurrent filing only . I would also like to know if we can send the 485 application to INS and receive the receipt date .Appreciate your help and time and effort .

AC21 is not limited to concurrent filing. You must have an I-485 pending for over 180 days, whether it was filed concurrently with the I-140 or not. By your statement below, I assume you have no pending I-485, therefore you are not eligible for AC21 portability.

I would also like to know if we can send the 485 application to INS and receive the receipt date.

Is your priority date current for your category (EB3 or EB2)? and country of birth? If not, then you cannot file an I-485.
