AC21 case: Salary significantly lower: Is it OK?

I have been out of job over a month. (485 has been filed over 14 months and still pending). I just got an offer from a well-known company, similar job, but significantly lower pay than what my labor certificate stated. (20%-30% lower). Would that be a problem if I get RFE in the near future? Should I take the offer or keep looking for a higher pay job (but job may not be that similar)?

What I would do is take up the job until I get a better one. You are okay if you don't get a RFE. I saw some approval posting by someone who had a salary lower than labor, got a RFE and also got approved without any issues. Please do an extensive search in this forum and you will definitely come across such issues.

Regarding low slary I am not sure but i read somewhere that INS doesn't mind nowdays considering economy

Also what is AC21 Is there any form we need to fill, How do we inform INS.

There is no formal form to fill out to avail AC21. It is upto u to inform INS/not. In case of employment RFE, you need to submit proof of employment with letter and paystubs. You can avail AC21 as long as ur case is not adjuncated within 180 days of filing.

Now I am asking another question about changing lawyer-

Since I have left the company where I filed I-485 over a year ago, the lawyer hired by my previous employer shows little interest in further assiting me. I am worrying about the possibility that if I get RFE in the near future, the lawyer will not notify me or simply telling INS I am unemployed even though I have got a new job by then.

So I am thinking of changing the lawyer. How should I do it? I know that I need to file certain form, and then just hire a new lawyer and pay him/her by hour (what is estimated cost?), is it correct?

Will it take a long time for INS to update the lawyer info so that they can send RFE to the new lawyer in the near future?

BTW, who knows some good immigration lawyer in NJ? Can you give the number?

You should have your I-485 receipt number (if not, get it from the old attorney) and keep tracking it on the phone or on-line system. If you see that an RFE has been issued, contact the attorney and get the RFE notice from them. The I-485 belongs to you unlike the I-140 which belongs to the company. You can then use a new lawyer to respond to the RFE (hopefully you wont get one). don't know any lawyers in NJ but you can use any lawyer in any state for immigration purposes. check out Rajin Khanna (this website) or sheila murthy.
