Hi,

I have an unusual situation.

My AOS was pending for more than 180 days, then company
fired me effective 11/30/01. I got a job starting 01/13/02,
attorney from old company did not revoke I140 and did not
file AC21 letter and I didn't have time since AOS got approved
on 01/23/02.

Now its time to apply for citizenship :-). Do you think not
filing AC21 letter will be a problem? My case is perfectly covered
by AC21 (AOS pending > 180 days, intention to work with
company but they fired me, same area (I'm a PhD) and am
now doing research at a university). But I nor Lawyer did
not file AC21 letter.

1. Does the INS even acknowledge you AC21 letter?
2. How will the officer adjuciating my citizenship case know if AC21
was filed?
3. Was it compulsory to file AC21 letter around 01/2002?

Thanks.

-----when did they fire you ? before I-485 approval or after I-485 approval?

----------------------- talk to your lawyer
1. Does the INS even acknowledge you AC21 letter?
-------------if you file request to invoke AC21 you dont get any letter from USCIS they attach the new job offer letter with pending I-485
2. How will the officer adjuciating my citizenship case know if AC21
was filed?
----------------he will have the I-485 file before him read the below document:
Adjudicator's Field Manual for Citizenship

Cizenship application review Process by USCIS officer

Talk to good lawyer or file Citizenship AFTER 5 years from date of I-485 approval.

Why should I talk to a lawyer.

I met the requirements of AC21. The INS memo (at the time)
said they expected people to let them know of job change,
but did not say you *must* let them know.

Am I missing something that will disqualify me from GC
and/or citizenship? As I said in another thread,
waiting for the original sponsor to disappear of my N400
form will look suspicious. The officer will know that the current
company was not the original sponsor since the AOS was filed
in CSC and the N400 will be filed at VSC!
