AC21 and Salary Question

I got laidoff recently, I got a job in another company and they are offering me 4.8% less than my LC Salary. Job title and description are similar/same. My labor was filed in Dec 2000. Both my last job and current job is in the same location. Searched through this forum and found responses both +ve and -ve related to less salary. Wanted to know if there are any such cases which are approved/rejected already. Any thoughts would really help me.

------not a big problem AC21 memo does not say anything about salary

Job title and description are similar/same.
------ if you are joining with EAD it is better to have same similar job duties. if join with H1 transfer then Only on future job permanent job offer letter from new employer you need the same/similar job duties to use AC21. GC is for future permanent job.
