AC21 and H1-b 7the year extension

I have already used AC21. My approved I-140 was withdrawn by previous employer , finally the case got reopned by MTR. I am still on H1-B with the new employer. My 6 years of H1 expire in Nov 2006. I never used EAD

After seeing the retrogression in October, I am thinking of settling down with a new company as I don't know how long the stay will be for Green Card from now on.

Can I go for H1 transfer with a new employer and get my H1 extended for 3 years ( considering the fact my I-140 which was approved has been withdrawn by my previous employer) . But My I-485 is now in a pending status as I used AC21.

I have the option of switching on EAD but would prefer to be on H1 just in case if my current employer tries to inform USCIS that I have left this company and no longer working with him.

---YES

--------------not for 3 years it can be extended for 1 year then again 1 year, those who got I-140 approved and cant file I-485 can extend H1 for 3 years
