AC21 and GC questions

Hi,

I work for Company A. After the independence day :D , I will get the 'perm-job-offer' from company B for AC21 purpose. But I will join company C first, next D and next E .....

Once I get the GC, I will join the Company B.

Is it possible/legal ?

Hi - I think the absolute necessary thing for you is to have an employement with similar job duty 'at the time of' I-485 approval.

Folks in different forums have their theories on what kind of freedom one has while the I-485 is pending for more than 180 days.

My bit conservative take away based on that is - work in the companies C, D,.. that have similar job duties (and at least the salary as was in your labor), and once you get the I-485 approval, join company B in ~6 months (post approval).

If the companies C, D, etc do not offer the similar job duties, then your situation is more complicated than what I know. May be couple of gurus in this forum can shed some light on this to help you out ?

When I work for Company D and if I get a RFE for "employment verification letter". Which company letter should I send it ( Company B (i.e AC21 company) or Company D (not informed about this company to USCIS) )

You are not required to be employed by the original or new company before getting the green card. So you can use company B for the letter.

However, if you are not working for and have never worked for the company, it may raise some doubts in the officer's mind about whether the new job offer and company are genuine, leading them to send additional RFE's about it. So if the jobs in company C, D, etc. are "same or similar" to the original job, and are reasonably expected to still exist after GC approval (i.e. they are not contract jobs with an expected end date), sending the letter from the company you are actually employed in would be better.

In my case company B (AC21 company) exisit and will do the "same or similar" job. As I don't plan to notify USCIS about my Company C, D, E etc for AC21 as they are all going to be "contract" jobs .

As AC21 notification is for "future employment", I thought of getting letter from the Company B will do in future if needed.

I can't send AC21 from company C, D, E etc as all are going to contract jobs.

Please help. Please let me know the best way to resolve this problem.

Job Description for AC-21

Hi Gurus,

I'm going to file AC-21 after 180 days of I-485 RD. My I-140 was approved 8 months ago.

My labor was filed for an Engineering postion, however, my new job title will be an Engineering Manager.

The basic area of responsibilities are the same, but the title is different and salary is more.

So, my questions are:

1. Is the new job title going to be a problem?

2. Can anyone please send me some samples of required letters for AC-21 that need to be sent to USCIS?

Then it looks like you have no choice. It's company B or nothing.
