AC21 and FingerPrinting

To exercise AC21 you must have a valid EAD and 6 months must have passed since you applied for I485.

I dont think finger printing is an issue in this.

This is my view... wait for more replies.

If I transfer on EAD, it means I need to have the following done
right?
1. I need to have EAD card
2. 140 should be cleared
3. Finger Printing
4. Advanced parole
 
I remember reading in the AC21 document that at least 6 months must have been passed since you applied for I485 in order to exercise AC21 while your 485 application is pending. If not then if god forbid the I485 application is adjudicated then it might create a big problem.

However i have heard about a few people changing employers even before 6 months and still got I485 approvals... I am not sure if they got any RFE's.

If join new employer you can join with H1 transfer (if you are on H1 status and EAD not used) join with EAD (if you have EAD in hand) , it means I need to have the following done
right?
1. You need to have valid EAD card in hand or file H1 transfer and the day you get H1transfer filing receipt join the new employer
2. 140 should be cleared AND I-485 pending more than 180 days
3. Finger Printing (not necessary)
4. Advanced parole (you need valid AP approved IN US before you depart US and enter before AP expiry) AP is not for work it is only for travel, you don’t need AP to join new employer

*** Join the new employer who is ready to give you future permanent job offer letter with same skills as on past employer approved LC (Form ETA 750A). new employer should agree to give you that letter so that you can use AC21
