AC21 and choice of jobs

Hi Folks,

My 485 receipt date is Mar 2002.

I left my employers (who filed my 485) in July 2003. I haven't had a job since but now I have a choice of 2 jobs.

My questions are as follows :

a) Does not having employment for the last 10 months affect my application ?

b) I have moved to WA state now. The 2nd FP notice that I just received is for CA. In AR11 that I am about to file the address will be WA. Do I still go to CA for FP or is there something else I need to do ?

c) Does the financial standing of the company that I am employed with at the time of adjudication matter? Will I have to produce papers showing the financial status of the company when my case is adjudicated ?

d) If GC is for a future job why do they send RFE for paystubs, tax returns etc. What should matter is that you are working with the new employer at the time of adjudication or offered a new permanent job by them. Is that right ?

----- I hope you got I-140 approved and I-485 pending more than 180 days, if you get new job and permanent job offer in similar field you are eligible to use AC21

---- I think it will not matter but you should be working before I-485 is approved

------ It means you or your lawyer never updated USCIS for your new address on I-485 and still USCIS has your earlier address on I-485 and that is the reason you gor FP for CA
In AR11 that I am about to file the address will be WA. Do I still go to CA for FP or is there something else I need to do ?

------------- you can do FP in CA or can reschedule the PF and update your address.

For example when one moves from location A to B he needs to do the below:
1 file form AR11 for address change
2 update NCSC on 18003755283, your new address, provide them your ,WAC,EAC or LIN # of I-485 and reciept # of any pending petitions with service center, provide the receipt#, your name, DOB, A#( A# is on I-485 filing reciept)
3 write letter to service center for address change on your I-485( if you have spouse I-485 pending He/she also need to change address on her/his I-485) or any pending petition with them provide your past and NEW address, attach I-485 receipt copy, write your name, DOB, A# on cover letter. Send the letter to your service center with certified return receipt and out side the envelope write in big bold letters ATTENTION: ADDRESS CHANGE

** if any RFE for I-485 it will go to lawyer who filed I-485, if you move better hire your lawyer and you sign new Form G28and new lawyer will send it to USCIS with your I-485 reciept copy and can also update your address on I-485 with USCIS

----They can ask and you have to provide, they want to check the ability to pay from company

---ask your lawyer or USCIS they will reply you
What should matter is that you are working with the new employer at the time of adjudication or offered a new permanent job by them. Is that right ?
------ it is better you should be working with employer whose job offer letter you are using for AC21
