AC-21 wrt retrogession

Now that many people will have to wait longer for i-485 many people would like to use AC-21 ( assume 180 days have passed and I-140 is approved )

Lets discuss folowing ( and other points that will come along the discussion).

1. Entire list of documents needed to file AC21 along with already sucessful sample letter.

2. If some of documents ( originals ) are not with us how to obtain them or what are alternatives.

3. Risks in AC21.

4. Exactly what support is needed from past and next employers

5. What if some processing is already done on I-485 , who will they send RFE to ? To us ,past employer or next employer . What if it goes to past employer and they donot have good relation with you.

6. If you have any contract of duration of working with past employer or money related contract - are they contracts legal and how they can be fought back.

You just need evidence of your new "same or similar" job.

Risks in AC21.

The risk is that your job is not truly "same or similar", which is quite low. There is also a small risk of having your case transferred for an interview.

Exactly what support is needed from past and next employers

None

What if some processing is already done on I-485 , who will they send RFE to? To us ,past employer or next employer. What if it goes to past employer and they donot have good relation with you.

Neither your previous nor your current employer is a party to your I-485. The RFE will go to your attorney.

If you have any contract of duration of working with past employer or money related contract - are they contracts legal and how they can be fought back.

That may or may not be enforceable. This is a civil issue which I cannot comment on.

I am planning to use AC 21, but i wasnt sure which job title and salary should i use.

My labor saying Programer Analyst with $ 52000 as salary and my 140 document used for filing 140 says Software Consuktant with $64000.

Mine is a sub - labor. which one should i go with for ac21?
Please advice
