AC-21 Title vs. Job Description

Hello All,

If new job description is very similar (almost the same), but title is totally different.

In my case:

Title on Labor Certification is Senior Staff Accountant
Title for new job is Operations Specialist

Would that be a problem?

The most recent statement from USCIS is that they look at the job description, (and I think also for salary) and then they match it with DOT. Titles have little significance. Be sure to have a good lawyer and good documentation description to demostrate that the jobs are similar.

This is what my attorney and my new employer attorney (i used AC 21) told:

1) Job skill set must be same, eventhough the job title is different.

2) Salaray can be same or higher.

---- it is good if Salaray is same or higher but august 2003 AC21 Memo does not state anything related to salary or location
 
Even the job description need not necessarily be the "same". But it should sound "similar". I never saw my LC and I filed my AC21 without knowing any wordings from my LC. But I knew that my job description would definitely sound "similar" to the adjudicating officer.
