AC 21 issue

Hi All,

I applied for my I140/485 in Jun 2004 and did not apply for EAD. I am still on a valid H1B visa which is valid till 2008. Lets say I get another offer, where they are willing to sponsor my H1B and lets suppose that my I-140 get approved in the meantime and 180 days have passed since filing my 485.

Can I then use Ac21 to switch jobs?

------ yes, you will be eligible for AC21 AFTER I-140 approval and to be safe if you want to change employer file for EAD and get EAD in hand becase new employer may not file H1 transfer . having EAD AP based on pending I-485 is good back up
