My new employer filed my 3year H1-B extension using my I-140 approval and EB3 retrogression.
I started with this firm using my EAD ( that's what I was told to - I don't have problems with that ).
Once I get my H1-B extension approval, is there a way I can use it.
-------use of EAD has invalidated your H1 status. how the new company after use of EAD filed the H1 extension? you are not on H1 status from the day you used EAD. may be the USCIS approve the H1 without I-94 attached and if you want to be on H1, go out and enter on H1 status
If I do so, when I go to India, can I return using my Advance Parole and keep extending my EADs as a back up

----- if you are on H1 status and use AP you dont invalidate H1 status but you are not on H1 status as you have used EAD. to be on H1 go to US consulate with H1 approval notice get visa stamp and enter on H1
I don't want to go to the visa office in India to get H1-B visa stamped in the passport.
